You must signify agreement to and an understanding of the following Terms of Usage, Agreement for Personal Data Processing, and Agreement to Receive Marketing Content by checking them in order to complete registration.

PORTAL TEST VERSION TERMS AND CONDITIONS www.where2B.org I. INTRODUCTION 1. www.where2b.org is an internet platform, run by Meant 2B Sp. z o.o. based in Krakow, allowing its Users to create personalized profiles (Accounts), upload photos, add descriptions, comments and information and share them with other Users, communicate directly with other Users, and access and comment photos and information added to the Portal by other Users. Additionally the Portal allows its Users to participate in discussion groups, signing up on the guest lists of cultural and social events promoted by Service Provider and – in instances defined in the present Terms and Conditions – editing Automatic Profiles. 2. The current version of the Portal is a test version, which means erros might occur, in particular – data, information, photos and other contents entered in the Portal might be lost, and using the Portal may negatively affect the both the software and the hardware of the computer used to use the Portal. As the Portal remains in the test phase Meant 2B sp. z o.o. does not hold any responsibility for damage caused by using the current test version of the Portal. This does not apply to damage caused on purpose. II DEFINITIONS The following terms used in this document are to be understood as follows: 1. Meant 2B, Service Provider – „Meant 2B” limited liability company, based in Krakow (address: Mazowiecka 46/18, 30-019 Kraków), KRS nr 0000295419, REGON: 120555015, NIP: 677 230 28 56, initial capital: 50.000,000 PLN, email address: where2b@where2b.org. 2. Terms and Conditions – the present document desribing the terms and conditions of usage of the test version of www.where2B.org portal 3. Portal, Portal www.where2b.org, – test version of www.where2b.org portal, which is mentioned in Chapter I 'Introduction', availible at the internet address (URL): www.where2b.org, run by Meant 2B Sp. z o.o. based in Krakow. 4. User – adult physical person possesing full legal capacity, who, by accepting the Terms and Conditions and registering, gains access to services provided by the Portal. User can also be a minor or a an adult without full legal capacity, under the consent of a legal proxy. 5. Account – a place in the Portal designated for a User using which the User enters data (information, photos, etc.) and manages it. Creating an Account is required to utilize all the Portal functions and services provided electronically by Meant 2B via the Portal. 6. Automatic Profile – a place in the Portal created automatically by the Portal as a result of User activity (filling in specific text fields), not assigned to any specific User but the right to edit it might be, in instances defined in the present Terms and Conditions, granted to one or limited number of Users. 7. Portal Concept – all kinds of data and information presented by Meant 2B through the Portal, including information on Meant 2B, educational materials, graphic elements and arrangement, trademarks (logos) of Meant 2B, Meant 2B company signatures, computer programs, regardless of the form of record and presentation of cuch data and information (e.g. Text, photos, graphics, multimedia materials). Messages, contents and other data entered in the Portal by User are not considered part of Portal Concept. 8. Copyrights – bill from February 4, 1994, about copyrights and neighboring rights (Dz. U. 1994 r. nr 24, poz. 83). 9. Portal Usage – using the services provided by the Portal, among others those concerning information, communication and searching. III. PORTAL 1. The Portal's content is created by its Users who submit data and contents (in particular – photos, comments and other contents) on the Portal. This is not to mean that Service Provider has no right to co-create the Portal's content. 2. Service Provider does not as a rule modify the data and contents submitted on the Portal by Users. Service provider does have the right though to delete data and contents submitted on the Portal by Users in situations described in Terms and Conditions and by legal rules. 3. Service Provider delivers to Users tools necessary to create Portal's content in the form of Portal Concept. 4. Service Provider informs that all the rights to non-material goods, i.e. Portal Concept and all its elements, belong to Service Provider. All elements of the Portal Concept, including articles, brochures, multimedia presentation, publications, photos, video, computer programs are considered compositions as understood by lagal regulations concerning Copyrights. Unless stated otherwise, Service Provider has the proprietary copyrights to the Portal Concept and all its elements, or has an appropriate license to utilize those elements on the Portal. IV. TERMS AND CONDITIONS 1. The present document defines the general rules of using the Portal, and also the rules of delivering services electronically by Meant 2B through the Portal, including rights, obligations and the scope of responsibility of Meant 2B as a subject governing and running the Portal. 2. Every person, regardless of the ability of acquring the status of the User, from the moment of undertaking action leading to using services provided by Meant 2B electronically through the Portal, is obliged to get accustomed with the Terms and Conditions and obeying all the rules stated there. Accepting Terms and Conditions upon creating and registering Account only serves evidential purpose and is required for fullfilling the requirements concerning personal data protection. 3. Terms and Conditions are considered a statute as understood in bill from July 18, 2002, about providing services in electronic way. 4. Every person, regardless of the ability of acquring the status of the User, can access, print, record and copy Terms and Conditions for free in any way. 5. Terms and Conditions are availible at the internet address (URL) http://new.where2b.org/terms in a form allowing for saving and opening in a regular way (as a HTML or PDF document). 6. On User's demand Meant 2B will make Terms and Conditions accessible to that User in an electronic way in the form of a PDF document sent to an email address provided by the User. 7. Some services delivered by Meant 2B through the Portal may have separate detailed regulations. User is obliged to get accustomed with them each time before using the service and obey them. 8. The Terms and Conditions were written in Polish and the Polish version is the only official one. All other language versions only serve auxiliary function, helping non-Polish speakers understand the terms and conditions on which services are provided. V. AMENDMENTS OF TERMS AND CONDITIONS 1. Meant 2B reserves itself the right to one-sidedly amend provisions of Terms and Conditions without the necessity to announce the reason of such action. 2. In the instance of amending provisions of Terms and Conditions Meant 2B will immediately inform Users about it by publishing the text of Terms and Conditions on the home page of the Portal, under a link 'Terms and Conditions'. In the instance of ammending provisions of Terms and Conditions in a way that affects the personal data protection, every User will be individually informed about such change and the condition of further usage of the portal will be accepting the new text of Terms and Conditions. Not accepting the new text of Terms and Conditions will result in blocking Account and terminating the agreement about delivering services electronically. 3. Terms and Conditions come into effect the day they are announced on the Portal. Agreements concluded between Users and Meant 2B before the coming of Terms and Conditions into effect are subject to Terms and Conditions upon announcing Terms and Conditions on the Portal. 4. In the instance of amendment or legal cancellation of any provision of the present Terms and Conditions by a legally valid decision of a court or other adequate body, other provisions remain legally binding for the parties. VI. TYPE AND SCOPE OF SERVICES DELIVERED ELECTRONICALLY 1. On the basis of Terms and Conditions, Service Provider delivers in an electronic way services allowing User to access data and information submitted on the Portal by displaying User's individual request on the Portal website under a given internet address (URL), and also allowing user to create contents of the Portal by, among other activitites, uploading files and other data (information, photos, and other) to the Portal and to communicate with other Users. Services provided electronically will in particular include: a. possibility to browse the Portal, b. possibility to use the search mechanisms of the Portal, c. possibility to download images submitted on the Portal by other Users, d. possibility to send files and other data (information, photos, and other) to the Portal in order to make them accessible for other Users, in particular possibility to edit contents of own Accounts and of Automatic Profiles that were not assigned for editing to other User or Users or that a User was granted right to edit, e. possibility to communicte with other Porscri tal Users by appropriate systems that allow sending, storing, and receiving such data, including, first of all, the possibility to exchange messages directly (aka 'priv') and the possibility to submit messages on a forum or in the form of comments, including on Accounts of other Users and Automatic Profiles, f. possibility to create contents of the Portal by submitting information about cultural and social events organized by User. 2. Service Provider is entitled to changing the scope of services provided electronically and introducing new services provided electronically. As the current version of the Portal is a test version, Service Provider stipulates that the usage of particular services mentioned in the previous paragraph might be temporarily impossible. VII. ACCOUNT 1. Using the services provided by Service Provider through the Portal, except for browsing parts of the Portal's content, is only possible after registering User and creating User's Account. Account creation results in concluding the agreement about providing services in an electronic way between User and Service Provider. 2. Registration and Account creation is done by filling in a form displayed on the screen after choosing from the main menu tab 'log in or register' and then choosing option 'create account'. Upon registration the agreement about providing services in an electronic way is concluded for indefinite period. 3. Creating Account User can select any Account name provided the name was not earlier chosen by other User. The Account name cannot violate the rights of third parties or contain words that are obscene or generally considered offensive. 4. Account User is obliged to provide during the registration proccess true personal data, including name and last name, birth date, and email address. Providing this data is necessary for using services provided electronically (except for browsing some parts of the Portal's content). 5. Service Provider will send the necessary information required to use the Portal to the email address provided by User. . 6. The last stage of the registration proccess and Account creation is agreeing to have personal data processed and made accessible, and also agreeing to receiving commercial information. 7. After finishing the registration proccess and Account creation, limited Account modification, including modifying personal data, is possible. 8. Accepting Terms and Conditions by User is equivalent to declaring the following: a. I declare that personal data provided in the registration proccess, Account creation and modification, and submitted on Account are truthful, b. I agree for my personal data, provided in the registration proccess and Account creation, to be proccessed by Service Provider for purposes serving the fullfilling of the agreement about providing services electronically, c. I agree for my image submitted in the Portal to be used by Service Provider for the purpose of delivering services on the Portal and I declare that the persons whose images I submitted on the Portal expressed such agreement, d. I agree to receive from Service Provider information about obstructions, changes and technical breaks in Portal's functioning, e. I declare that submitting personal data, images and information about third parties on Account took place under interested parties' consent and in a legal and voluntary way. 9. Account creation and registration is voluntary. User does not pay anything for creating, registering and using User Account. This does not mean that Service Provider cannot charge for other services provided through the Portal. Service Provider also reserves the right to introduce payments for using Account in the future. VIII. AGREEMENT TERMINATION 1. Each party of the agreement about providing services in an electronic way can terminate it at any time with an immediate effect, without stating the reason. The agreement is terminated by deleting Account. 2. Service Provider has the right to delete User's Account at any time, in particular when User violates the provisions of the present Terms and Conditions. Account deletion can be preceded by sending a waring to User. 3. User has the right to delete Account at any time by selecting 'delete Account' option in settings menu under login menu. Then, an email is sent to User with a request to confirm Account deletion. Confirmation results with deleting Account. 4. Account deletion results in losing the User status by the person who created Account. 5. Account deletion does not result in deletion of all data and contents submitted by User on the Portal outside Account, in particular on Accounts of other Users or Automatic Profiles. IX. AUTOMATIC PROFILE 1. Automatic Profile are created by Service Provider or as a result of User activity on the Portal (filling in specifc text fields) and can be edited by all Users with the exceptions stated below. Editing Automatic Profiles includes in particular adding contents and data to them (images, files, messages, and other). 2. Every User can be granted right to edit Automatic Profile exclusively, if a given profile was planned to be edited by User. 3. In order to obtain an exclusive right to edit Autoamtic Profile User sends a request to Service Provider stating that editing of Automatic Profile will not violate rights of third parties. 4. If, at the moment of such request, no other User claimed the right to edit Automatic Profile and no other User claimed the right to the name and contents of Automatic Profile, User receives the right to edit Automatic Profile. 5. From the moment of receiving the right to exclusively edit Automatic Profile by User other Users have no right to edit Automatic Profile. 6. If Service Provider receives information that editing of given Automatic Profile by User violates rights of third parties (regardless of possibility of granting that third party User status) or the regulations of the presnt Terms and Conditions, and also in the instance of contention as to who is entitled to editing a given Automatic Profile, Service Provider has the right to block User or take away User's right to edit Automatic Profile. In such instance, Service Provider also has the right to delete contents and data (images, files, messages, and other) submitted by User on Automatic Profile. 7. If Service Provider receives reliable information that a given person is entitled to editing Automatic Profile, Service Provider can grant that person right to edit Automatic Profile. X. RULES OF USING THE PORTAL 1. As User uses the services provided electronically by Service Provider, User is obliged to: a. obeying the existing principles of law, good manners and widely conventional rules of using the Internet, b. not utilizing the Portal for any unlawful actions or actions against good manners and also violating rights of third parties, c. not carrying out any actions that would violate the privacy of other Users, e.g. phishing (obtaining private information in an illegal way), collecting, proccessing and publishing information about other Users without their consent, d. not carrying out any actions leading to sending spam and unwanted commercial information through the Portal, e. not carrying out any actions posing a threat to the security of computer systems of Service Provider or third parties. 2. User is in particular obliged not to submit to the Portal any content or data (photos, messages, other) of unlawful character, in particular: a. content or data violating existing prinicples of law or good manners, including content portraying or promoting violence, hatred, discrimination, and also erotic or pornographic content, excluding erotic art - Service Provider has however the right to assess such contents individually and remove at any time. b. content or data violating or potentially violating rights of other bodies (physical persons, legal persons or organization units with no legal identity), in particular proprietary or personal copyrights, corporate secrets, corporate property rights, image rights or other personal goods of other bodies, c. content or data being computer programs or information (files, source files, etc.) that could be used for stopping, distrupting or hampering computer system of Service Provider and Users, unlawful accessing the computer system of Service Provider and unlawful data damaging. 3. In the instance of submitting by User to the Portal – especially submitting content and data (photos, files, messages, and other) on Account or Automatic Profile – data considered unlawful, offensive, false, against the existing principles of law or in any way against the provisions of Terms and Conditions, Service Provider can remove such content or data as well as make it impossible to access or store content or data. 4. User, by submitting on Account or Automatic Profile content or data (photos, files, messages or other, including personal data), agrees for other Users and Service Provider to access such content or data and download it by other Users and Service Provider, and gives Service Provider the right to use it according to Terms and Conditions. 5. In the instance of submitting by User to the Portal content or data being a composition protected by copyrights (or parts of such content or data being such composition) or being any other subject of intellectual proprietary rights, User, by submitting such content or data to the Portal, affirms that he is fully entitled to rights to the composition or subject of intellectual proprietary rights, including complete proprietary copyrights. User, therefore, takes responsibility for Service Provider using the composition or subject of intellectual proprietary rights and affirms that it will not violate any rights of third parties. 6. In the instance of submitting by User to the Portal content or data being a composition protected by copyrights, the moment User sends such content or data to Service Provider using the Portal's functionality, User authorizes Service Provider to utilize the composition, also outside the Portal, in the scope of all utilization fields known at the moment of sending, including in particular recording and copying of the composition – producing copies of the composition using a specific technique, including print, reprography, magnetic and digital record; putting in circulation, lending and renting the original or copies of the composition, making the composition publically accessible in a way that allows anyone to access it in the place and time chosen, including in particular making the composition accessible for other Users on the Portal, and also using it for promotional and marketing purposes of the Portal and other products and services. 7. In the instance of submitting by User to the Portal content or data being goods protected by other intellectual proprietary rights (or parts of such content or data being such goods), including corporate secrets or image, the moment User sends such content or data to Service Provider using the Portal's functionality, User authorizes Service Provider to utilize the intellectual property goods, also outside the Portal. 8. Authorizations mentioned in paragraphs 6 and 7 are granted for indefinite time and without the necessity to bear any costs on grounds of granting such authorizations and further utilization of compositions or goods protected by intellectual property rights. XI. RULES OF SERVICE PROVIDER'S RESPONSIBILITY 1. Service Provider makes efforts leading to providing the highest quality services. Considering that the current version of the Portal is a test version, errors might occur, in particular – data, information, photos and other content entered in the Portal might be lost, and using the Portal may negatively affect the both the software and the hardware of the computer used to use the Portal. 2. Service Provider cannot be hold responsible for distruptions or errors in the Portal's functioning, including disruptions leading to losing data, information, photos or other content submitted on the Portal and disruptions having a negative effect on both the software and the hardware of the computer used to use the Portal. 3. Service Provider cannot also be hold responsible for inability (temporary and permanent) to use any function of the Portal or any service delivered electronically through the Portal by Users, resulting from implementing changes and upgrades in the Portal Concept, and also resulting from resigning from some functions of the Portal or services provided in an electronic way. Users might be notified with adequate notice about technical breaks and their duration. It is not however Service Provider's responsibility to do so. 4. Service Provider is not responsible for data and content submitted on the Portal by Users. 5. Service Provider is not responsible for actions taken by other bodies on the basis of information gathered through the Portal. XII. TECHNICAL SPECIFICATION FOR USING THE PORTAL 1. In order to use the Portal User has to possess teleinformatic system of the following minimum specification: a. Internet access, b. web browsers installed and used to use the Portal: Mozilla Firefox 3.5, Google Chrome 5.0, Safari 4 or newer, configured in a way allowing for using Java Script, Cookies, and SSL, c. using in some instances Flash 10 software or newer versions 2. As the Service Provider delivers services in an electronic way, the following items might be installed in User's teleinformatic system: Cookies files, 3. The Portal's design has been optimized for web browsers in 1024x768 resolution or higher. XIII. PRIVACY POLICY 1. The administrator of Users' personal data is Service Provider. 2. Service Provider, as Administrator of personal data, takes care of security of data provided in accordance with existing principles of law. 3. Service Provider, as Administrator of personal data, guarantees to Users execution of rights resulting from bill from August 29, 1997 about personal data protection (Dz.U. 1997 nr 133, position 883) and bill from July 18, 2002 about providing services in an electronic way (Dz.U. 2002 nr 144, position 1204), in particular the right to acceess own data, the right to request update on own data or removing data, and the right to raise an objection in instances defined by provisions of the bill. 4. Database of personal data stored by the Portal was submitted to the General Inspector of Personal Data Protection, in accordance with the bill from August 19, 1997 about personal data protection (Dz.U. 1997 nr 133, position 883). 5. Personal data proccessing, under the consent from Users, will be done for purposes serving the fullfilling of the agreement about providing services electronically, and also for marketing purposes, including in particular promotion of serives provided by Service Provider, promotion of events, and also to allow Users to sign up on guest lists of cultural and social events promoted by Service Provider. Personal data gathered during the process of Using the Portal will be made accesible for other parties, including other administrators of personal data, under the consent from Users, for makreting and statistical purposes, only in a collective form that makes individual identification impossible. 6. The consent mentioned above is voluntary but it is required for Account creation. 7. In the proccess of using the Portal the following data about User's way of using the service provided electronically is automatically stored: IP address, domain name, type of browser, type of operation system. Service Provider will use this information only for technical and statistical purposes. 8. Service Provider gives information about personal data to government authorities for purposes of proceedings carried out by them. Such personal data can be given to authorized bodies on the basis of existing prinicples of law also in case of violating the rights of Service Provider or other bodies. 9. Service Provider reserves the right to send Users unannounced messages through the Portal, Automatic Profiles and Accounts assigned to Users, and also through electronic mail and e-mail addresses provided by Users. 10. Commercial content can only be sent to Users under their consent, in accordance with the provisions of art. 10 of the bill from July 18, 2002 about providing services in an electronic way (Dz. U. 2002, Nr 144, pos. 1204). Such consent is required for Account creation.. 11. Service Provider guarantees Users the access to current information about technical resources possessed by Service Provider preventing unauthorized parties from accessing and modifying personal data submitted electronically, and in the instance of concluding and agreement about giving another body the charge over personal data processing, also the information about such body and the scope and the time of such transfer. 12. Information mentioned in paragraph 10 are made accessible for User under internet address (URL) http://new.where2b.org/terms. XIV. COMPLAINTS 1. In the instance of inadequate fullfilling of the provisions of the agreement about providing services in an electronic way User can raise a complaint. 2. To raise a complaint User sends the content of the complaint via electronic mail to Service Provider, to the electronic mail address mentioned in Chapter II, paragraph 1 of Terms and Conditions or sends a registered letter to the address mentioned in Chapter II, paragraph 1 of Terms and Conditions. 3. Service Provider will examine the complaint within 14 days after receiving it. In the instance of incapability of taking an attitude toward the complaint in the time limit mentioned ebove, Service Provider will inform User about it and will provide an expected time of investigating the complaint. 4. The answer to the complaint will be sent by Service Provider to the electronic mail address of the User or correspondence address provided by the User. Complaints with no electronic email address of the User or no correspondence address of the User will not be considered. XV. FINAL REGULATIONS 1. The present Terms and Conditions come into effect on the day of the announcement, that is May 25, 2010. 2. In cases not regulated in Terms and Conditions adequate prinicples of Polish law apply.

PERSONAL DATA PROCESSING AGREEMENT I agree for my personal data, submitted in the registration and Account creation procedure on the www.where2B.org Portal and also while using the Portal, to be processed by Meant 2B Sp. z o.o., located in Krakow (address: Mazowiecka 46/18, 30-019 Krakow), registered in Register of Companies of the National Court Register run by the Regional Court of Krakow-Srodmiescie in Krakow, 11th Economic Department, with the KRS number 0000295419 and REGON number 120555015 and NIP 677 230 28 56, possesing initial capital of 50'000 PLN, for marketing purposes, especially for promotion of services provided by Meant 2B Sp. z o.o. and promotion of cultural and social events organized and promoted by Meant 2B Sp. z o.o., and also for the purpose of allowing Portal Users to sign up on the guestlists of cultural and social events promoted by the Service Provider. I also agree for the data defined above, collected in the process of using the www.where2B.org Portal, to be made accessible to other parties, including other administrators of personal data, for marketing and statistical purposes, but only in a collective form that doesn't allow for personal identification.

AGREEMENT FOR RECEIVING MARKETING CONTENT I agree to receive advertisements and other content of marketing character sent via electronic means of communication on the email address provided in the registration and Account creation procedure on the www.where2B.org Portal and also on my Account on the www.where2B.org Portal.
